Kumuha po ako ng pre-selling condo unit nung AUG. 2014, and sbi nila sisimulan n dw yng ground breaking by DEC. 2014. after ko daw mabayaran yung 36 months DP by 2017 pwd ko na daw matirhan and tapos na yung construction. lumipas ang taon, pag nagtatanong po ako skanila if kelan sisimulan ang construction, paiba iba na po sila ng cnsv skn. medyo nakakaduda na. at last na nagtanong ako wala pa daw exact date kung kelan masisimulan. at lagi cnsv skn “SIR GS2 NYO PO BIGYAN NA NMIN KAYO NG UNIT PARA MAGAMIT NYO NA YNG BINABAYAD NYO” ibig nila sbhin yung lumang bldg. bibigyan dw nila ko ng unit dun.. xmpre ayaw nmin kc mag 3yrs. na kmi nag babayad ng DP so mas lalo pa lumuma yun db. and khit masimulan nila yng construction ng 2017. kelan pa po matatapos yun diba so mag aantay nnmn kami. pero as of now wla prn cla mabigay skn if kelan masisimulan.
Ang tanong ko po, pwd ko po ba makuha yun lahat ng binayad ko if hindi prn cla nagsisimula ng construction by end of 2017? or after nmin matapos yung 3yrs DP sa AUG. 2017? and nag rerent po kmi now sa tita ko.. may DAMAGES din po ba cla skn? Thank you very much po more power and God bless.

In this case, since the seller failed to fulfill his obligations to you, then you can file a case against him under Presidential Decree No. 1344. You have to allege that you are a victim of his fraudulent acts and that he has not substantially complied with his obligations as provided for in the contract. You can file a case with HLURB and may even get a full refund of your payments. You can file a claim now, especially when it appears that they will not be able to fulfill their obligation to finish construction and allow you to move in by August 2017.
